What Is My Injury Case Worth?

The short answer is that your case is worth as much or as little as you are willing to take – within certain limits. A general way in which insurance companies calculate the settlement value of a clear liability, soft tissue, non-surgical case is to multiply your medical expenses by 1.5 or 2. If this is an amount that works for you, then you will likely be offered his amount by the insurance company.

However, if the insurance company’s offer is too low for you, you have other options. You should hire an attorney as soon as possible to discuss your case and a reasonable value. If you need to, your attorney can file a lawsuit against the other driver and proceed with litigation over your injury case. Often this will demonstrate to the insurance company that you are not going to take their “low ball” offer. In other words, if they want to settle, they will have to increase the offer.

In the event that the insurance company still won’t make an offer that will work for you, you can present your case to a jury at trial. There are risks to both you and the insurance company when a case goes to trial, but an experienced injury attorney can explain this as it relates to your case.
